Deloitte & Touche LLP has been appointed by the Ontario Superior Court of Justice and the Québec Superior Court of Justice as the Claims Administrator of the FMF Capital Group Ltd. Securities Class Action Settlement (the "Settlement").
The Notice of Certification and Approval of Settlement (the “Notice”) is a court-approved summary of the Settlement. To review the Notice, click here.
Registering a Claim for Compensation
All persons who come within the definition of a class member will automatically be included in the Class unless they exclude themselves by Opting Out.
You are a Class Member if you purchased FMF Capital Group Ltd. ("FMF") income participating securities in the March 2003 initial public offering and/or over the TSX during the period from March 24, 2005 to and including November 15, 2005, and you are not an Excluded Person.
According to the terms of the Settlement, Claims should be submitted electronically, prior to the Claims Deadline, using the Online Claim System. Documentation of all FMF IPS transactions is required to substantiate each registered Claim.
The deadline to register a Claim is August 13, 2007.

Opting Out of the Settlement
Any class member who does not wish to participate in the Settlement must Opt Out prior to the Opt Out Deadline. A class member who opts out will not be eligible for any of the benefits of the Settlement. Do not opt out if you wish to share in the benefits of the Settlement.
The deadline to Opt Out of the Settlement is July 16, 2007.

If a Class Member does not have access to a computer with Internet connectivity, has difficulty with the Online Claims Process, or prefers not to register a claim online, they may commence the claim process by telephoning the Claims Administration Help Line at 1-866-669-6615.
The final distribution of compensation to eligible Class Members or their designated Representatives has been issued. The Compensation Notice and accompanying payment were based on the court approved Distribution Protocol. This payment represents the final benefit entitlement under the terms of the settlement. Should either the Class Member or their Representative NOT have received a Compensation Notice, please contact the Claims Administrator.
The deadline to register a Claim, and submit the complete Claim Package to the Claims Administrator is August 13, 2007.
The deadline to register an Opt Out, and submit the Opt Out Claim Package to the Claims Administrator, and if required, the Clerk of the Québec Court, is July 16, 2007.
